1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ActiveHours LLC ("ActiveHours," "Company," "we," "us," or "our"), a Delaware limited liability company operating at activehours.us.
By accessing or using our website, clicking "Apply Now," submitting a loan application, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
These Terms apply to all visitors, applicants, and customers. If you are using our services on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility Requirements
To use our services, you must meet all of the following requirements at the time of application:
- Be at least 18 years of age (or the age of majority in your state, if higher)
- Be a US citizen or lawful permanent resident with a valid government-issued photo ID
- Have a valid Social Security Number
- Reside in a state in which ActiveHours is licensed to operate
- Have a verifiable, regular income of at least $800 per month
- Have an active US checking or savings account open for at least 90 days
- Have a valid, active email address and US phone number
- Not have an active, unpaid loan with ActiveHours
- Not be in active bankruptcy proceedings
We reserve the right to verify eligibility requirements and to deny applications that do not meet our underwriting criteria. Meeting the above criteria does not guarantee loan approval.
3. Description of Services
ActiveHours LLC provides short-term consumer installment and single-payment loans ("Loans") to eligible US residents through our website. Our services include:
- Online loan applications and instant credit decisioning
- Loan origination, servicing, and collection
- Customer account management
- Customer support via phone and email
ActiveHours is a direct lender. We are not a loan broker, marketplace, or lead generator. We do not sell your application or personal information to other lenders.
Our services are available to residents of eligible US states only. The availability of specific loan amounts and terms varies by state. We reserve the right to modify, suspend, or discontinue any part of our services at any time without notice, except as required by law.
4. Loan Application Process
4.1 Accuracy of Information
You represent and warrant that all information you provide in your loan application is true, accurate, current, and complete. Providing false, misleading, or fraudulent information in connection with a loan application is a violation of these Terms and may constitute fraud under applicable federal and state law.
4.2 No Obligation to Lend
Submitting a loan application does not create any obligation on the part of ActiveHours to approve or fund a loan. Loan approval is subject to our underwriting criteria and applicable state law. We reserve the right to decline any application without providing a reason, subject to ECOA adverse action notice requirements.
4.3 Application Fees
There is no fee to apply for a loan. You will never be asked to pay any upfront fee before receiving loan funds. Any request for upfront payment as a condition of receiving a loan is fraudulent — do not comply.
4.4 Credit Inquiry
By submitting an application, you authorize ActiveHours to obtain consumer report information from credit reporting agencies. We perform a soft credit inquiry only, which does not affect your credit score.
4.5 Identity Verification
You authorize ActiveHours to verify your identity using third-party identity verification services and to obtain information from public and private databases for this purpose.
5. Loan Agreement
If your application is approved and you choose to proceed, you will be presented with a Loan Agreement containing the following disclosures, as required by the Truth in Lending Act (TILA):
- The exact loan amount (principal)
- The finance charge (flat fee)
- The Annual Percentage Rate (APR)
- The total amount due at repayment
- The repayment due date
- The payment method (ACH debit)
Your electronic signature on the Loan Agreement constitutes your legally binding acceptance of those terms. Electronic signatures are valid under the Electronic Signatures in Global and National Commerce Act (E-Sign Act) and applicable state law.
You have the right to review the Loan Agreement before signing. If you have any questions, contact us before signing. You may decline to sign at any time before submission with no obligation.
Once signed, the Loan Agreement is a binding contract. Read it carefully. The finance charge is non-refundable once funds are disbursed, except where required by applicable state law.
6. Repayment Terms
6.1 Automatic Repayment
By signing your Loan Agreement, you authorize ActiveHours to initiate an ACH debit from your designated bank account for the total repayment amount on the agreed due date. You are responsible for ensuring sufficient funds are available in your account on the due date.
6.2 Returned Payments
If a payment is returned due to insufficient funds or any other reason, we may: (a) retry the debit; (b) charge a returned payment fee as disclosed in your Loan Agreement and permitted by applicable state law; and (c) report the delinquency to applicable databases. Your bank may also charge you an NSF fee.
6.3 Prepayment
You may repay your loan in full at any time before the due date by contacting us. There are no prepayment penalties. Upon receipt of full repayment, we will cancel any scheduled ACH debit.
6.4 Late Payment
If your loan is not repaid by the due date, it becomes delinquent. Late payment consequences may include: additional fees as permitted by state law, collection activity, referral to a third-party collection agency, and reporting to credit bureaus or specialty consumer reporting agencies. We will always notify you before referring your account to collections.
6.5 Collections
ActiveHours and any collection agency we use will conduct collection activities in compliance with the Fair Debt Collection Practices Act (FDCPA) and applicable state law. You have rights under the FDCPA. For more information, contact the CFPB at 1-855-411-2372.
6.6 Extensions and Hardship
If you are unable to repay on time, contact us before your due date. We may, at our discretion and subject to applicable state law, offer a loan extension (rollover), extended repayment plan, or hardship accommodation. Extensions incur an additional finance charge.
7. Prohibited Conduct
You agree not to:
- Provide false, inaccurate, or fraudulent information in any application or communication
- Apply for a loan on behalf of another person without their knowledge and consent
- Use our services if you are not eligible under Section 2
- Attempt to obtain multiple simultaneous loans from ActiveHours
- Use automated tools, bots, or scripts to access or scrape our website
- Attempt to circumvent any security measure on our website
- Use our services for any purpose that violates applicable law
- Interfere with or disrupt our website, servers, or networks
- Impersonate ActiveHours or any ActiveHours employee
- Use our website to transmit malware, spam, or unsolicited communications
Violation of these prohibitions may result in immediate termination of your account, denial of future applications, and/or referral to law enforcement authorities.
8. Intellectual Property
All content on activehours.us — including but not limited to text, graphics, logos, icons, images, page layout, and software — is the property of ActiveHours LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use our website for personal, non-commercial purposes in connection with our services. You may not:
- Copy, reproduce, distribute, or create derivative works from any content on our site without prior written permission
- Use our trademarks, logos, or brand elements without prior written permission
- Frame or mirror our website on any other website
- Reverse engineer any software or technology used on our site
9. Disclaimers
9.1 Not Financial Advice
Nothing on activehours.us constitutes financial, legal, tax, or investment advice. We strongly recommend consulting a qualified financial advisor before taking on any debt obligation. Our loan products are short-term tools — not long-term financial solutions.
9.2 Website Availability
Our website is provided on an "as is" and "as available" basis. We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify or discontinue the website at any time.
9.3 Third-Party Links
Our website may contain links to third-party websites. We are not responsible for the content, privacy practices, or security of any third-party website. Linking to a third-party site does not constitute an endorsement.
9.4 APR Disclosure
Annual Percentage Rates (APR) disclosed on our website are calculated per TILA requirements for comparison purposes. Our products are short-term loans; APR is not an accurate representation of the cost of borrowing for a period of less than one year. The actual cost is the flat finance charge stated in your Loan Agreement.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ACTIVE HOURS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OUR WEBSITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNT OF THE FINANCE CHARGE PAID BY YOU ON THE MOST RECENT LOAN TRANSACTION.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless ActiveHours LLC and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our website or services
- Your violation of these Terms
- Any false or inaccurate information you provide to us
- Your violation of any applicable law or third-party rights
12. Arbitration Agreement and Class Action Waiver
Important: This section requires you to resolve disputes through binding arbitration rather than in court, and you waive your right to participate in class actions. Read carefully.
12.1 Agreement to Arbitrate
Any dispute, claim, or controversy arising out of or relating to these Terms, the Privacy Policy, our website, or our services (collectively, "Disputes") shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Delaware, unless you and we agree to a different location or to conduct it telephonically.
12.2 Exceptions
The arbitration agreement does not apply to: (a) small claims court actions within applicable limits; (b) injunctive or other equitable relief for intellectual property infringement; or (c) any claim that applicable law requires to proceed in court.
12.3 Class Action Waiver
YOU AND ACTIVE HOURS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
12.4 Your Right to Opt Out
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by sending written notice to: ActiveHours LLC, Attn: Legal Dept., 1234 Financial Ave Suite 500, Wilmington DE 19801. Opting out does not affect any other provision of these Terms.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law principles, except where preempted by applicable federal law or where your state's mandatory consumer protection laws provide greater protections.
For claims not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page
- Post a prominent notice on our website for at least 30 days
- If you have an active loan or account, notify you by email
Changes to these Terms do not apply retroactively to existing Loan Agreements already signed. Your continued use of our website after the effective date of revised Terms constitutes your acceptance of those Terms.
